インド最高裁判所は、軍隊において男女平等を尊重するよう命じた。
今まで、女性は最大14年までの兵役に制限されており、軍の立法および教育部門を除いて指揮官のポストに就くことはできなかった。
過去に政府は女性と男性には同じ身体能力がなく、兵士たちは精神的な面で女性に導かれることに慣れていないと述べていた。
しかし、最高裁判所はジェンダーのステレオタイプによって軍隊内で差別を認めることはできないと考える。
「女性陸軍士官は、その存在をわざわざ容認しなければならない男性支配的な施設の補助者ではないことにそろそろ気付くべきだ」と裁判所は述べた。
The Indian Supreme Court ordered the respect of gender equality in the army.
So far, women were limited to a maximum of 14 years of service and couldn’t have access to the post of commands except in the legislative and educational branches of the military.
Previously the government stated that women and men did not have the same physical abilities and that soldiers were not mentally ready to be led by women.
However, the Supreme Court considered that gender stereotypes couldn’t constitute a factor of discrimination in the army.
“Time has come to realize that female army officers are not auxiliaries to a male-dominated establishment whose presence must be tolerated,” said the court.
