3人の男性は、男性間の性的行為を犯罪とする377Aを取り消すようにシンガポールの高等裁判所に異議を申し立てた。
イギリス植民地時代の1938年に制定されたこの法律は、もともと男性の売春を防ぐことを目的として制定。
シンガポールの法律では、公の場または私的な場で性的行為を行った男性同士は、最大2年間拘置される。これは男性間同士にのみ適用され、女性間同士の場合には刑事罰にはならない。
「立法上の目的は、同意による成人男性間の性的親密さの私的且つ非営利的な行為を標的にするものではない。セクション377Aが行うことは、少数派の男性同性愛者に対して、多数派による「古き良き時代の差別」を単に主張したい為である。」と申立人の弁護士は述べる。
これまでのところ、この法律を取り消そうとする試みはすべて失敗している。

Created in 1938 during the British colonization, the law was originally intended to prevent male prostitution.
Any man committing a sexual act in public or in private with another man can be jailed for up to two years. This only apply to men gay sex, the Singaporean laws do not criminalize female lesbian sex.
“The legislative purpose was never to target private, non-commercial acts of sexual intimacy between consenting male adults. All that Section 377A does is to simply express the majority’s ‘good old-fashioned discrimination’ against male homosexuals, who are a minority,” argued the complainants’ lawyers.
So far, all attempts to revoke this law have failed.
