生まれた時には男性だった東南アジア出身の女性に対し、彼女が日本に来てから30年近く経ってようやく在留許可が出た。
現在58歳のその女性は、1981年に興行ビザで来日、ビザが切れたあとも25年以上不法滞在という形で日本に居続けた。女性は1993年にパートナーである日本人男性と出会い、2002年から一緒に暮らしている。
2013年、女性は肺がんを患ったが、ビザがないことから健康保険にも加入しておらず、それゆえパートナーと二人で全額自己負担で治療費を賄った。
2017年3月、彼らは入国管理局において自分たちの状況を整えようと決めた。
2019年8月、女性は正式に住民として認められた。
「我々は、熟慮の上でこの決定を下した。女性の日頃の行い、生活習慣、どの程度社会に溶け込んでいるかなどと共に、博愛的な考慮も含めた上で決定したことだ」と入国管理局は述べた。
9月2日に行われた会見では、女性は匿名で、在留許可と健康保険が認められたことを涙ながらに感謝した。
しかし、法律的観点から言えば、このカップルは女性がもともとは男性として生まれたため、男性同士のカップルと見なされている。
A South-East Asian woman, born male was granted a residency visa after spending almost 30 years in Japan.
Now aged 58 years old, she arrived in Japan in 1981 with an entertainment visa, despite overstaying her visa she stayed in Japan, living illegally for more than 25 years.
In 1993, she met her partner, a Japanese man, and moved in together in 2002.
In 2013, she got lung cancer, but due to the lack of a proper visa and therefore health insurance, she and her partner had to cover all the costs.
In March 2017, they decided to regularize her situation with the immigration office.
In August 2019, she was granted residency.
“We made the determination comprehensively based on the woman’s behavior, lifestyle and degree to which she has settled into society as well as humanitarian considerations,” said the immigration office.
During a press conference on September 2, the woman, willing to stay anonymous, thanked with tears in her eyes, Japan for her visa and for her access to health insurance.
However, from a legal point of view, the couple is considered as male and male because she was born male.
