200以上もの企業が、最高裁判所に対し、性的指向やジェンダーアイデンティティーによる職業差別を国家レベルで禁止するよう求めている。
現在、連邦公民権法において、LGBTの人たちを保護するような法律はない。オバマ(Obama)がLGBTの人たちも保護対象に含めようとした決定がトランプ(Trump)政権によって撤回させられたあと、トランプ大統領は1964年に制定された公民権法はLGBTの人たちを保護するようには作られていないと主張している。
1964年に定められた公民権法は、人種、肌の色、宗教、性別、出身国による差別を禁止している。制定当時、性的指向に関しては特にその対象として定められていなかった。
最高裁判所に訴えている企業は、それら全てを合わせると700万以上の従業員と５兆円にも及ぶ年間売り上げがある。これらの企業にはアマゾン(Amazon)、コカ・コーラ(Coca-Cola)、ドミノピザ(Domino’s Pizza)、ゴールドマンサックス(Goldman Sachs)、IBM、マイクロソフト(Microsoft)、ナイキ(Nike)、スターバックス(Starbucks)、ウォルトディズニー(Walt Disney)など多数の企業が名を連ねている。
企業がすでに非差別ポリシーを持っていたからといって、それは法に代わるものではないと訴えを起こしている企業らは主張する。
最高裁判所は、この件に関して10月8日から討議を開始する予定だが、ニール・ゴルサック(Neil Gorsuch)とブレット・カバナー(Brett Kavanaugh)という二人のトランプ支持者が任命されたあと保守傾向が強くなっている中で、果たして彼らがLGBTの人たちにとって好ましいルールを定めるのかはわからない。
More than 200 companies are asking the Supreme Court to ban job discrimination based on sexual orientation and gender identity on a national level.
Currently there is no protection for LGBT people in the Federal Civil Rights after a step back from Obama’s decision to include them by the Trump administration, arguing the Federal Civil Rights act of 1964 wasn’t intended to protect LGBT employees.
The 1964 act outlaws discrimination based on race, color, religion, sex, or national origin. Sexual orientation wasn’t specified at that time.
The companies pressing the Supreme Court represent more than 7 million employees and $5 trillion in annual revenue. This includes Amazon, Coca-Cola, Domino’s Pizza, Goldman Sachs, IBM, Microsoft, Nike, Starbucks, and Walt Disney among many others.
Even if all these companies already have non-discrimination policies, they argue it can’t replace the law.
The Supreme Court will start debating on the topic from October 8, but given its conservative majority after the appointment of Neil Gorsuch and Brett Kavanaugh, two Trump supporters, it is unpredictable if the court will rule in favor of the LGBT community or not.
