2018年9月19日から、同性のパートナーは異性のカップルと同じように、家族滞在ビザ(dependent visa)を申請することができる。この決定は政府ではなく、司法によって決定された。
7月、香港の最高裁判所は、採用オファーがでた同性パートナーのいる英国の女性に、配偶者ビザを与えなければならないと判決を下した。裁判所は、国際結婚が無効であるかどうかを決定する必要はないとし、 婚姻が申請者の出身国で有効であった場合、入国審査では婚姻を否定する権利がないとした。
グローバル企業にとってこの決定は、有能な人材を惹きつけるのに役立つと考えられる。

Hong Kong’s top court ruled in July that a British woman should be granted a spousal visa – which allows dependents to work without the need for a separate visa – after her partner was offered work in the financial hub. The court ruled in that immigration did not have to decide if a foreign marriage was invalid or not because it linked people of the same sex. If the marriage was valid in the country of origin of the applicants, the immigration had no right to reject it.
For the internationals companies this decision means they will have more ease to attract new talents.
